Nintendo files lawsuit against the United States over Trump tariffs

Last spring President Donald Trump imposed customs duties under the International Emergency Economic Powers Act (IEEPA). They hit the gaming sector hard, and Nintendo announced it would no longer tolerate their impact.

Court rulings

- On February 20 the U.S. Supreme Court declared part of Trump's tariffs unlawful and struck down several of them.
- The President responded with a promise to impose new duties.

Nintendo’s lawsuit

Nintendo of America sued in an American trade court, demanding the return of duties paid by the platform holder (with interest) — mainly those that the Supreme Court overturned.

The complaint stresses that the tariff imposition was unlawful and led to the collection of over $200 billion from almost all countries. The company’s lawyers insist: “all duties collected under IEEPA must be refunded with interest.” They also claim that the U.S. government has acknowledged this fact in other court documents.

Why it matters for Nintendo

At the time the tariffs were imposed, the company was preparing to launch Switch 2. Due to new expenses Nintendo postponed the start of pre‑orders in the United States but did not change the console’s price or release date.

Players usually view Nintendo’s legal actions skeptically (often related to copyright protection or anti‑emulation efforts). However, in this case many supported the Japanese giant, seeing its lawsuit as a fair response to unjustly imposed duties.
