The court demanded a refund from Netflix for the unfair price increase on subscriptions, but only in one state
Italian court demands refunds to Netflix customers
What happened
- Problem: Netflix repeatedly unlawfully raised subscription prices in Italy.
- Consequence: Customers gained the right to demand a refund of paid money, as well as possible reduction of current rates.
Who sued and why
Consumer Association Movimento Consumatori (consumer association) filed the claim. Netflix violated the Italian consumer code by failing to explain the reasons for price changes in user agreements.
- Key point: The platform did not provide sufficient grounds for increasing subscription costs and other terms.
Court ruling
1. Date of decision: April 1.
2. Subject matter: Four instances of price increases from 2017 to 2024.
3. Possible compensations:
- Premium subscribers who paid continuously since 2017 – up to €500.
- Standard subscribers – up to €250.
- Even basic tier users faced price hikes.
What Netflix must now do
- Deadline: 90 days to notify all current and former customers in Italy of their right to a refund.
- Notification channels: email, regular mail, the company’s website, and print Italian press.
- Breach penalty: fixed weekly fine.
Limitations of the ruling
- The decision applies only in Italy; it does not extend to Netflix subscribers abroad.
- The court considered local consumer‑protection legislation.
- Netflix plans to appeal the ruling.
Thus, Italian users can now expect refunds for unlawfully raised rates, but this is limited to Italy and depends on specific subscription terms.
