Epic Games and Google Reach Settlement
Epic Games CEO Tim Suwinski, known for his candor, nearly brought the dispute with Apple and Google to the U.S. Supreme Court. For a long time he publicly called these companies “unfair,” “dishonest,” and “bandits,” and Android a “copy of an open platform.”
However, on March 3, 2024 Epic Games signed a settlement with Google in which Suwinski waives the right to file lawsuits against Google and further public critical statements about app store policy.
> “Epic believes that after the changes outlined in this preliminary agreement, the Android platform promotes competition and serves as a model for app stores,” the document states. This means Suwinski may be required to defend the agreement in courts worldwide, while Google will ensure his public remarks align with the agreed position.
Before signing the deal Epic created and funded the “Coalition for Fairness in Apps,” fighting against Apple and Google. After the transaction the company remains a coalition member, but further conflicts can arise only with Apple.
The obligations take effect once Google makes final changes to app store service fees. The agreement lasts five years: from the moment of changes until September 30, 2027. Consequently, Tim Suwinski will be restricted in criticizing Google and its app store up to September 2032.
